Hanna-Maija Elo and Emilia Hodge from Properta will be discussing exhaustion of trade mark rights at the upcoming Helsinki IP Summit on 10 November 2021 at 15:00.
The theme is highly topical in Finland and in the EU, as the Supreme Court of Finland and the Court of Justice of the European Union are expected to provide guidance on the question of whether there exists a legitimate reason to oppose refilling and relabelling of CO2-cylinders used in sparkling water makers following first sale within the same Member State.
How far can a right holder reach? The question will be discussed in the light of EU-level legislation and previous case law.
Helsinki IP Summit is targeted to IP practitioners, business leaders and managers, startups, law and business students and academics in the IPR field. The event is organised by the IPR University Center. This year’s Helsinki IP Summit is a two-day hybrid event, which can be attended both online by following the live stream or on site at the Paasitorni Congress Center in Helsinki. The event will feature speeches by more than forty IPR professionals and business representatives on current IPR topics.
